USER LICENSE AGREEMENT AND PRIVACY POLICY NOTICE TO ALL USERS: READ THE TERMS AND CONDITIONS OF THE FOLLOWING LICENSE AGREEMENT (“AGREEMENT”) CAREFULLY BEFORE USING BKAV MOBILE SECURITY SOFTWARE. YOU CAN USE BKAV MOBILE SECURITY ONLY UPON THE CONDITION THAT YOU ACCEPT ALL OF THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT, STOP USING BKAV MOBILE SECURITY. IF YOU AGREE TO THESE TERMS AND CONDITIONS, CLICK ON THE “AGREE” BUTTON. 1. License Grant Bkav Mobile Security is a software product protected by intellectual property law, copyright law and other laws of the Socialist Republic of Vietnam. You may: - Install and use Bkav Mobile Security if you have a license of Bkav Mobile Security. - Install one license of Bkav Mobile Security on a single smartphone or tablet. You may not: - Debug, reverse engineer, decompile, disassemble or make any attempt to view, discover, or study the source code or the command code of Bkav Mobile Security or perform any similar acts. - Modify, crack, patch, or make any attempt to change Bkav Mobile Security’s operation. - Create derivative works based upon Bkav Mobile Security in whole or in part. - Use Bkav Mobile Security in any manner not authorized by this Agreement. 2. Privacy Policy - Bkav Pro needs to access SMS to receive anti-theft commands from user via SMS. - Bkav Pro needs to have the right to locate and take photos in the background to use the Anti-Theft function of the app. In case the phone is lost, the user can rely on the location, the photo taken from the camera to find and retrieve. - Bkav Pro does not use SMS, location and photos for purposes other than anti-theftt - Bkav Pro only saves/stores/archive SMS/contacts/call log data in case users use the Backup & Restore function and select the form of Save/Store/Archive (tůy th?c t? ?ng d?ng dang důng t? nŕo) on Bkav Server, this data is encrypted and not used for purposes other than backing up and restoring data. These information will be stored during the time customers use the software, the data will be deleted after the usage period expires. 3. Updates Bkav Mobile Security is automatically updated on a regular basis. If you own a license of Bkav Mobile Security, you may obtain Bkav Mobile Security updates during the valid period of the license. 4. Free usage You are still granted the right to use Bkav Mobile Security with limited features free of charge, but are forbidden to use Bkav Mobile Security for commercial purposes. Bkav reserves the right to limit, add, remove, modify features of Bkav Mobile Security, as well as the right to terminate your free use of Bkav Mobile Security without prior notice. 5. Information for better data protection During the time using Bkav Mobile Security, you agrees to provide Bkav with the information such as suspicious files, executable files, checksums; license being in use; information about the smartphone or tablet; information about operating system; the configuration of your smartphone or tablet, memory and disk space, installed programs and active processes information, log file information, statistics of Bkav Mobile Security usage, etc. for the purpose of updating the software, supporting users, making statistics, researching, announcing and warning about the security trends. You agree to allow Bkav Mobile Security to send SMS to support the anti-theft feature. You agree to provide Bkav and its Affiliates with your personal information such as name, physical address, phone number, email address etc. for purposes of providing technical support, product renewal and other services. “Affiliates”: any business and/or organization, including but not limited to subsidiaries, that directly or indirectly, control, are controlled by, or are under common control with Bkav. 6. Responsibilities THEORETICALLY, DUE TO OBJECTIVE OR SUBJECTIVE IMPACTS, OR DUE TO THE IMPACTS OF THE OPERATING SYSTEM OR OF THE CONFLICT BETWEEN BKAV MOBILE SECURITY AND OTHER SOFTWARE RUNNING ON THE SAME SMARTPHONE OR TABLET, THERE MIGHT BE ERROR DURING THE TIME YOU USE BKAV MOBILE SECURITY. IN NO EVENT MAY YOU ASK FOR COMPENSATION FOR ANY DIRECT OR INDIRECT DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR: SYSTEM’S AVAILABILITY, LOSS OF DATA, LOSS OF OPPORTUNITIES, LOSS OF MONEY, OR SPIRITUAL LOSS ARISING OUT OF THE USE OR INABILITY TO USE BKAV MOBILE SECURITY. IN NO CASE WILL REPARATION DUTY EXCEED THE PURCHASE PRICE FOR BKAV MOBILE SECURITY. THE DISCLAIMERS AND LIMITATIONS SET FORTH ABOVE WILL APPLY REGARDLESS OF WHETHER YOU ACCEPT THE AGREEMENT. 7. General Information - This Agreement shall be subject to the law of the country in which Bkav Corporation (hereinafter referred to as Bkav) is headquartered. - All legal relations between the parties, including matters relating to torts, shall be subject to the law of the country in which Bkav is headquartered. - This Agreement shall be subject to the law of the country in which Bkav is headquartered. The place of jurisdiction shall be in the country in which Bkav is headquartered. All matters relating to the validity, interpretation and fulfillment of the contractual provisions including but not limited to matters relating to torts shall be settled in the country in which Bkav is headquartered. - Should you have any queries regarding this License Agreement, further information can be found at www.bkav.com. The Original Agreement shall take full legal effect in any circumstance. Any translation of the Original Agreement shall be for convenience only. In the event that any part of a translation differs from the Original Agreement, the Original Agreement shall supersede the translation.
